The SPDR(R) S&P 500 ETF (SPDR Trust, Series I, NYSE Alternext US: SPY

The Energy Select Sector SPDR(R) Fund (NYSE Arca: XLE - News)
and SPDR(R) DJ Wilshire Total Market ETF (NYSE Arca: TMW - News),
announced today that each Fund received payments from a class action
settlement as eligible claimants related to Enron Corporation.
The total amount payable to each Fund is listed below. When each Fund
calculates its net asset value ("NAV") per share on December 29, 2008,
it is estimated that each Fund's NAV will be impacted by the receipt of
the corresponding payments in the amount stated below based on the
shares outstanding as of December 24, 2008.
